Dear Attorney General Cuomo:
Recently, elected members of the Westchester Conservative Party filed a lawsuit with the New York State Supreme Court in Westchester County alleging that forged and fraudulent proxy ballot signatures were used to endorse County Executive Andy Spano and District Attorney Janet DiFiore. Yesterday, I called on District Attorney Janet DiFiore to appoint a special prosecutor to investigate these serious charges.
I am pleased that she has now notified your office of the matter. I respectfully request an expeditious investigation to determine if there was criminal activity in awarding the endorsements of the Conservative Party line with fraudulent proxy ballots. These serious charges, if found to be committed, amount to Fraud in the Second Degree, a class D felony, punishable by up to 7 years in prison. Due to the time restraints of the November 3rd election, it is imperative that these allegations be investigated and any findings of criminal wrongdoing be prosecuted to the fullest extent of the law.
